1) Scope

These General Terms and Conditions (GTC) of Melt Cookies GmbH (hereinafter referred to as "Seller") apply to all contracts for the sale and delivery of goods that a consumer concludes with the Seller via the online shop.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to his or her commercial nor to his or her independent professional activity.


2) Conclusion of contract

2.1 The products presented in the online shop do not constitute a binding offer, but serve to submit a binding offer by the customer.

2.2 The customer submits a binding offer by completing the ordering process and clicking the "Buy now" button. Orders can also be placed via email.

2.3 The contract is concluded when the seller confirms the customer’s order by email or delivers the goods.

2.4 The contract language is German.

2.5 Order processing is generally automated and carried out via email. The customer must ensure that their email address is correct and that they can receive emails from the seller.


3) Right of withdrawal

Consumers generally have a right of withdrawal. Details of this, including statutory exceptions (e.g. for sealed foodstuffs that are not suitable for return due to hygiene reasons), can be found in the Cancellation policy of the seller.


4) Prices and payment terms

4.1 All prices in the shop are final prices in euros and include VAT. Shipping costs are listed separately.

4.2 Available payment methods (e.g., credit card, PayPal, Sofort/Klarna, SEPA, iDEAL, Bancontact, Apple Pay, Google Pay) are displayed during the ordering process. Payments are processed via secure payment service providers such as Stripe, Klarna, Mollie, or PayPal.

4.3 In the case of credit card payments, the account will be debited upon conclusion of the contract.


5) Delivery and shipping conditions

5.1 Deliveries shall be made to the delivery address specified by the Customer within the delivery area specified by the Seller.

5.2 If delivery fails for reasons for which the customer is responsible (e.g., incorrect address, refusal of acceptance), the customer shall bear any resulting additional costs. This does not apply if the customer effectively exercises their right of withdrawal.

5.3 Delivery times, shipping costs and available delivery areas are specified in the respective product information.

5.4 No deliveries will be made on Sundays and public holidays.

5.5 Self-collection is possible by arrangement. The pickup address will be communicated during the ordering process or in the order confirmation.


6) Retention of title

The goods remain the property of the seller until full payment has been made.


7) Liability for defects (warranty)

The statutory liability for defects applies.


8) Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.


9) Alternative dispute resolution

The seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
